These Terms of Service (the "Terms") govern your access to and use of the Go Uns mobile application, website, and related services (together, the "Service"), operated by Go Uns ("Go Uns," "we," "us," or "our"). Go Uns is a map-first social presence app for the Kingdom of Saudi Arabia ("KSA") that displays a living heat map where "heat" reflects real people present in an area, lets you check in to a place to see activity and chat with others, and lets you choose how you appear for each check-in: shown (the default — your name, photo and the place are visible to other signed-in users) or hidden (you are counted in the aggregate and never shown individually).
Please read these Terms carefully. They contain important provisions, including a binding limitation of liability and an assumption of risk relating to meeting strangers.
1.1. By creating an account, downloading, accessing, or using the Service in any way, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
1.2. If you use the Service on behalf of another person or entity, you represent that you are authorized to accept these Terms on their behalf.
1.3. These Terms form a legally binding agreement between you and Go Uns. Your continued use of the Service after any update to these Terms constitutes acceptance of the updated Terms.
2.1. The Service is intended only for individuals who are 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old.
2.2. Identity details you give at registration. Your date of birth, your name, and your gender. We use your date of birth to confirm you are 18 or older and to keep the App age-appropriate; your name is how friends recognise you; gender is used only for the aggregate, non-identifying "mix" shown for a place, and only above the threshold in Section 6.2. These are stored with your account and deleted when you delete your account. We handle them in accordance with the Saudi Personal Data Protection Law ("PDPL").
2.3. The Service is not directed to children, and we do not knowingly permit anyone under 18 to use it. If we learn that a user is under 18, we will suspend or terminate the account and delete associated data in accordance with our Privacy Policy and applicable law.
2.4. You are responsible for ensuring that your use of the Service is lawful in your location.
3.1. Account creation. To use core features, you may need to create an account. You agree to provide accurate information where requested and to keep your credentials secure. You are responsible for all activity that occurs under your account.
3.2. You choose how you show up. A check-in has two modes: shown (the default — your name, photo and the place are visible to other signed-in users) or hidden (you are counted in the aggregate and never shown individually). Users who have not checked in as shown appear only in aggregate information (see Section 6).
3.3. No impersonation. You may not impersonate any other person, misrepresent your affiliation, or use the Service to deceive others.
3.4. One person, real use. You may not create accounts through automated means, sell or transfer your account, or operate multiple accounts to evade enforcement actions.
3.5. Security. Notify us promptly at the contact in Section 14 if you suspect unauthorized use of your account. We are not liable for losses arising from your failure to safeguard your credentials.
4.1. You agree to use the Service only for lawful, personal, non-commercial purposes and in compliance with all applicable laws and regulations of the Kingdom of Saudi Arabia, including the Anti-Cyber Crime Law and the PDPL.
4.2. You agree not to:
(a) violate any applicable law, regulation, or the public order, morals, or values of KSA;
(b) post, share, or transmit content that is unlawful, defamatory, obscene, pornographic, sexually explicit, hateful, threatening, harassing, or that incites violence or discrimination;
(c) post content that infringes intellectual property, privacy, or other rights of any third party;
(d) use the Service to facilitate prostitution, human trafficking, the sale of illegal goods, fraud, or any other criminal activity;
(e) attempt to identify, de-anonymize, track, stalk, surveil, or locate any individual user, or aggregate data to do so;
(f) harvest, scrape, or collect data about other users or about the heat map by automated means;
(g) reverse engineer, decompile, interfere with, overload, or attempt to gain unauthorized access to the Service or its systems;
(h) upload viruses, malware, or any harmful code; or
(i) use the Service in any manner that could disable, damage, or impair it.
4.3. We may, but are not obligated to, monitor, review, or moderate content and conduct, and we may remove content or restrict access at our discretion.
5.1. You are solely responsible for your interactions with other users, including any messages you send, content you share, and any decision to meet another user in person.
5.2. You agree to treat other users with respect and not to engage in harassment, bullying, hate speech, threats, sexual harassment, or unsolicited sexual content.
5.3. Reporting and blocking. The Service provides tools to report abusive content or conduct and to block other users. You agree to use these tools rather than retaliate. We may act on reports at our discretion, including by removing content, warning, suspending, or terminating accounts.
5.4. We do not conduct background checks on users and do not verify the identity, conduct, or intentions of any user.
6.1. How presence works. When you enable location, the Service uses your device location to place you within the heat map and to power place-based discovery. Your individual presence is exposed to other users only through a check-in you make yourself, in the mode you chose — shown (the default — your name, photo and the place are visible to other signed-in users) or hidden (you are counted in the aggregate and never shown individually). Outside your own shown check-ins, other users see only aggregate counts of how many people are present in an area or place.
6.2. Demographic mix threshold. Any demographic mix or breakdown for a place is shown only when at least eight (8) people are present, so that no individual can reasonably be singled out.
6.3. "Look away" stores nothing. When you use the "look away" function, no record of that view is stored.
6.4. Location. To find places near you, your device sends your precise location to our servers, where it is used to answer that request and then discarded — it is not written to our records. What other people can see is never precise: the map and any presence shown to others are based on an approximate area of around one (1) kilometer, and a shown check-in shows the venue you checked into, not your GPS position. The one exception is a trip you deliberately share, which stores the coordinates you chose to send, for as long as that share lasts.
6.5. Device permissions. Location features depend on permissions you grant at the operating-system level. You can disable location access at any time through your device settings, though doing so will limit or disable certain features.
6.6. No guarantee of accuracy. Heat-map data, presence counts, and demographic information are estimates and may be inaccurate, delayed, or incomplete. You should not rely on them as a statement of who is actually present at any location.
6.7. Our full data practices are described in the Privacy Policy. In the event of a conflict between these Terms and the Privacy Policy regarding personal data, the Privacy Policy controls.
7.1. Go Uns is a tool for discovering social activity around you and may lead to interactions with people you do not know ("strangers"). Meeting strangers carries inherent risks, including the risk of dishonesty, misrepresentation, offensive or unlawful behavior, physical harm, theft, or other harm.
7.2. You assume all risk arising from your interactions with other users, whether online or in person. Go Uns does not screen, vet, endorse, or supervise users, and is not a party to, and bears no responsibility for, any interaction or meeting between users.
7.3. You agree to exercise caution and good judgment, including: meeting in public places, telling someone you trust where you are going, not sharing sensitive personal or financial information, and contacting local authorities immediately if you feel unsafe or witness or experience unlawful conduct.
7.4. To the fullest extent permitted by law, you release Go Uns from any and all claims, demands, and damages arising out of or related to any interaction with, or conduct of, another user, including any in-person meeting.
8.1. Your content. The Service lets you create and share content, including room chat messages, photos, and "Moments" (collectively, "User Content"). You retain ownership of your User Content.
8.2. License to Go Uns. By submitting User Content, you grant Go Uns a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting and display), distribute, and display your User Content solely for the purpose of operating, providing, securing, moderating, and improving the Service. This license ends when your User Content is deleted, except (a) where it has been shared with others who have not deleted it, and (b) for retention required by law or for backup, dispute resolution, or enforcement purposes.
8.3. Your responsibility and warranties. You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate these Terms or any law or third-party right. You must not post images of other people without their consent.
8.4. No obligation to store. We are not obligated to store, retain, or back up your User Content and may delete it consistent with our retention practices and these Terms.
8.5. Feedback. If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or compensation.
9.1. By you. You may stop using the Service and delete your account at any time. Deletion is handled in accordance with our Privacy Policy.
9.2. By Go Uns. We may suspend, restrict, or terminate your access to all or part of the Service, with or without notice, if we reasonably believe that: (a) you have violated these Terms or applicable law; (b) your conduct may harm other users, third parties, or Go Uns; (c) it is required by law or a competent authority; or (d) we discontinue the Service.
9.3. Effect of termination. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (including Sections 7, 8.2, 10, 11, 12, 13, and 14) will survive termination.
10.1. The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Go Uns disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that heat-map data, presence counts, demographic information, or any other content will be accurate, reliable, or complete.
10.3. We are not responsible for the conduct of any user or third party, whether online or offline, and we make no representations regarding any user.
11.1. To the fullest extent permitted by applicable law, in no event will Go Uns or its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service, your interactions with other users, or any User Content.
11.2. To the fullest extent permitted by applicable law, Go Uns's total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amounts you paid to Go Uns for the Service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred Saudi Riyals (SAR 100).
11.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable KSA law.
12.1. To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Go Uns and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your interactions with or conduct toward other users, including any in-person meeting; (d) your violation of these Terms; or (e) your violation of any law or third-party right.
13.1. We may modify, suspend, or discontinue the Service or any feature at any time.
13.2. We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by in-app notice or by updating the "Last updated" date). Your continued use of the Service after the changes take effect constitutes acceptance. If you do not agree, you must stop using the Service.
14.1. Governing law. These Terms and any dispute arising out of or relating to them or the Service are governed by the laws and regulations of the Kingdom of Saudi Arabia.
14.2. Dispute resolution. The parties will first attempt to resolve any dispute amicably through good-faith negotiation. If the dispute is not resolved within thirty (30) days, it will be submitted to the competent courts and authorities of the Kingdom of Saudi Arabia, which will have exclusive jurisdiction.
14.3. Language. These Terms are provided in English and Arabic. In the event of any conflict or inconsistency, the Arabic version prevails before the courts and authorities of KSA.
14.4. Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
14.5. Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Go Uns regarding the Service.

تحكم شروط الخدمة هذه ("الشروط") وصولك إلى تطبيق Go Uns للهواتف المحمولة والموقع الإلكتروني والخدمات ذات الصلة (ويُشار إليها مجتمعةً بـ "الخدمة") واستخدامك لها، والتي تُشغّلها Go Uns ("Go Uns" أو "نحن" أو "نا"). إن Go Uns تطبيق تواجد اجتماعي قائم على الخريطة موجّه للمملكة العربية السعودية ("المملكة")، يعرض خريطة حرارية حيّة تعكس فيها "الحرارة" وجود أشخاص حقيقيين في منطقة ما، ويتيح لك تسجيل الحضور في مكان لرؤية النشاط والمحادثة مع الآخرين، ويمنحك الخيار في كيفية ظهورك عند كل تسجيل حضور: ظاهر (الوضع الافتراضي — يظهر اسمك وصورتك والمكان للمستخدمين المسجّلين الآخرين) أو مخفي (تُحتسب ضمن العدد التجميعي ولا تظهر بشكل فردي أبداً).
يُرجى قراءة هذه الشروط بعناية. فهي تتضمن أحكاماً مهمة، من بينها تحديد للمسؤولية مُلزم وإقرار بتحمّل مخاطر مقابلة الغرباء.
1.1. بإنشائك حساباً أو تنزيلك للخدمة أو وصولك إليها أو استخدامك لها بأي شكل، فإنك توافق على الالتزام بهذه الشروط وبسياسة الخصوصية الخاصة بنا، المُدرجة بالإشارة إليها. وإذا لم توافق، فلا تستخدم الخدمة.
1.2. إذا كنت تستخدم الخدمة نيابةً عن شخص آخر أو جهة أخرى، فإنك تُقرّ بأنك مخوّل بقبول هذه الشروط نيابةً عنه.
1.3. تُشكّل هذه الشروط اتفاقية مُلزمة قانوناً بينك وبين Go Uns. ويُعدّ استمرارك في استخدام الخدمة بعد أي تحديث لهذه الشروط قبولاً للشروط المُحدّثة.
2.1. الخدمة مخصصة فقط للأشخاص الذين تبلغ أعمارهم 18 عاماً فأكثر. وباستخدامك للخدمة، فإنك تُقرّ وتضمن أنك تبلغ من العمر 18 عاماً على الأقل.
2.2. بيانات التعريف التي تقدّمها عند التسجيل. تاريخ ميلادك، واسمك، وجنسك. نستخدم تاريخ الميلاد للتأكد من أنك تبلغ 18 عاماً أو أكثر وللحفاظ على ملاءمة التطبيق للفئة العمرية؛ ويُستخدم اسمك ليعرفك أصدقاؤك؛ ويُستخدم الجنس فقط ضمن "المزيج" التجميعي غير المُعرِّف الذي يظهر للمكان، وفوق الحد المذكور في القسم 6.2 فحسب. وتُحفظ هذه البيانات مع حسابك وتُحذف عند حذفه. ونتعامل معها وفقاً لنظام حماية البيانات الشخصية السعودي ("النظام").
2.3. الخدمة غير موجّهة للأطفال، ولا نسمح عن عِلم لأي شخص دون 18 عاماً باستخدامها. وإذا علمنا بأن مستخدماً دون 18 عاماً، فسنوقف الحساب أو نُنهيه ونحذف البيانات المرتبطة به وفقاً لسياسة الخصوصية والقانون المعمول به.
2.4. أنت مسؤول عن التأكد من أن استخدامك للخدمة قانوني في موقعك.
3.1. إنشاء الحساب. لاستخدام الميزات الأساسية، قد تحتاج إلى إنشاء حساب. وتوافق على تقديم معلومات دقيقة عند الطلب والحفاظ على سرية بيانات الدخول الخاصة بك. وأنت مسؤول عن جميع الأنشطة التي تتم عبر حسابك.
3.2. أنت تختار كيف تظهر. لتسجيل الحضور وضعان: ظاهر (الوضع الافتراضي — يظهر اسمك وصورتك والمكان للمستخدمين المسجّلين الآخرين) أو مخفي (تُحتسب ضمن العدد التجميعي ولا تظهر بشكل فردي أبداً). أمّا من لم يسجّل حضوراً ظاهراً فلا يظهر إلا ضمن المعلومات الإجمالية (انظر القسم 6).
3.3. عدم انتحال الهوية. لا يجوز لك انتحال هوية أي شخص آخر، أو تحريف انتمائك، أو استخدام الخدمة لخداع الآخرين.
3.4. شخص واحد، استخدام حقيقي. لا يجوز لك إنشاء حسابات بوسائل آلية، أو بيع حسابك أو نقله، أو تشغيل حسابات متعددة للتهرب من الإجراءات التنفيذية.
3.5. الأمان. أبلغنا فوراً عبر جهة الاتصال في القسم 14 إذا اشتبهت في استخدام غير مصرّح به لحسابك. ولسنا مسؤولين عن الخسائر الناجمة عن إخفاقك في حماية بيانات دخولك.
4.1. توافق على استخدام الخدمة فقط لأغراض شخصية مشروعة وغير تجارية وبما يتوافق مع جميع الأنظمة واللوائح المعمول بها في المملكة العربية السعودية، بما في ذلك نظام مكافحة الجرائم المعلوماتية ونظام حماية البيانات الشخصية.
4.2. توافق على عدم القيام بما يلي:
(أ) مخالفة أي نظام أو لائحة معمول بها أو النظام العام أو الآداب أو القيم في المملكة؛
(ب) نشر أو مشاركة أو إرسال محتوى غير قانوني أو تشهيري أو فاحش أو إباحي أو جنسي صريح أو يحض على الكراهية أو يهدّد أو يُضايق أو يحرّض على العنف أو التمييز؛
(ج) نشر محتوى ينتهك الملكية الفكرية أو الخصوصية أو غيرها من حقوق أي طرف ثالث؛
(د) استخدام الخدمة لتسهيل الدعارة أو الاتجار بالبشر أو بيع السلع غير القانونية أو الاحتيال أو أي نشاط إجرامي آخر؛
(هـ) محاولة تحديد هوية أي مستخدم فردي أو كشف هويته أو تتبّعه أو ملاحقته أو مراقبته أو تحديد موقعه، أو تجميع البيانات للقيام بذلك؛
(و) جمع أو كشط أو تحصيل بيانات عن المستخدمين الآخرين أو عن الخريطة الحرارية بوسائل آلية؛
(ز) الهندسة العكسية أو فك الترجمة أو التدخل في الخدمة أو إثقالها أو محاولة الوصول غير المصرّح به إليها أو إلى أنظمتها؛
(ح) رفع فيروسات أو برمجيات خبيثة أو أي شيفرات ضارة؛ أو
(ط) استخدام الخدمة بأي طريقة قد تُعطّلها أو تُلحق بها الضرر أو الخلل.
4.3. يجوز لنا، دون أن نكون ملزمين، مراقبة المحتوى والسلوك ومراجعتهما والإشراف عليهما، ويجوز لنا إزالة المحتوى أو تقييد الوصول وفقاً لتقديرنا.
5.1. أنت وحدك المسؤول عن تفاعلاتك مع المستخدمين الآخرين، بما في ذلك أي رسائل ترسلها، وأي محتوى تشاركه، وأي قرار بمقابلة مستخدم آخر شخصياً.
5.2. توافق على معاملة المستخدمين الآخرين باحترام وعدم الانخراط في المضايقة أو التنمّر أو خطاب الكراهية أو التهديد أو التحرش الجنسي أو المحتوى الجنسي غير المرغوب فيه.
5.3. الإبلاغ والحظر. توفّر الخدمة أدوات للإبلاغ عن المحتوى أو السلوك المسيء وحظر المستخدمين الآخرين. وتوافق على استخدام هذه الأدوات بدلاً من الانتقام. ويجوز لنا التصرف بناءً على البلاغات وفقاً لتقديرنا، بما في ذلك إزالة المحتوى أو التحذير أو الإيقاف أو إنهاء الحسابات.
5.4. نحن لا نُجري فحوصاً للسوابق عن المستخدمين، ولا نتحقق من هوية أي مستخدم أو سلوكه أو نواياه.
6.1. كيف يعمل التواجد. عند تفعيلك للموقع، تستخدم الخدمة موقع جهازك لتحديد مكانك ضمن الخريطة الحرارية ولتشغيل الاكتشاف القائم على الأماكن. ولا يظهر وجودك الفردي للمستخدمين الآخرين إلا عبر تسجيل حضور تقوم به بنفسك وبالوضع الذي اخترته — ظاهر (الوضع الافتراضي — يظهر اسمك وصورتك والمكان للمستخدمين المسجّلين الآخرين) أو مخفي (تُحتسب ضمن العدد التجميعي ولا تظهر بشكل فردي أبداً). وخارج تسجيلات حضورك الظاهرة، لا يرى المستخدمون الآخرون سوى أعداد إجمالية لعدد الأشخاص الموجودين في منطقة أو مكان.
6.2. حد المزيج الديموغرافي. لا يُعرض أي مزيج أو تفصيل ديموغرافي لأي مكان إلا عند وجود ثمانية (8) أشخاص على الأقل، بحيث لا يمكن بشكل معقول تمييز أي فرد بعينه.
6.3. "النظر بعيداً" لا يخزّن شيئاً. عند استخدامك لميزة "النظر بعيداً"، لا يتم تخزين أي سجل لتلك المشاهدة.
6.4. الموقع. للعثور على الأماكن القريبة منك، يرسل جهازك موقعك الدقيق إلى خوادمنا، حيث يُستخدم للإجابة على ذلك الطلب ثم يُتلف — ولا يُكتب في سجلاتنا. أمّا ما يراه الآخرون فليس دقيقاً أبداً: تعتمد الخريطة وأي حضور يظهر للآخرين على نطاق تقريبي يقارب كيلومتراً واحداً (1 كم)، وتسجيل الحضور الظاهر يعرض المكان الذي سجّلت فيه لا موقع جهازك. والاستثناء الوحيد رحلة تشاركها عمداً، فتُحفظ الإحداثيات التي اخترت إرسالها طوال مدة تلك المشاركة.
6.5. أذونات الجهاز. تعتمد ميزات الموقع على الأذونات التي تمنحها على مستوى نظام التشغيل. ويمكنك تعطيل الوصول إلى الموقع في أي وقت عبر إعدادات جهازك، علماً بأن ذلك سيحدّ من بعض الميزات أو يُعطّلها.
6.6. عدم ضمان الدقة. بيانات الخريطة الحرارية وأعداد التواجد والمعلومات الديموغرافية هي تقديرات وقد تكون غير دقيقة أو متأخرة أو غير مكتملة. ولا ينبغي لك الاعتماد عليها كإفادة عمّن هو موجود فعلاً في أي موقع.
6.7. توضح سياسة الخصوصية ممارساتنا الكاملة المتعلقة بالبيانات. وفي حال وجود تعارض بين هذه الشروط وسياسة الخصوصية بشأن البيانات الشخصية، تكون الغلبة لسياسة الخصوصية.
7.1. Go Uns أداة لاكتشاف النشاط الاجتماعي من حولك وقد تؤدي إلى تفاعلات مع أشخاص لا تعرفهم ("الغرباء"). إن مقابلة الغرباء تنطوي على مخاطر متأصلة، من بينها مخاطر عدم الصدق أو التحريف أو السلوك المسيء أو غير القانوني أو الأذى الجسدي أو السرقة أو غير ذلك من الأضرار.
7.2. أنت تتحمّل كامل المخاطر الناشئة عن تفاعلاتك مع المستخدمين الآخرين، سواء عبر الإنترنت أو شخصياً. إن Go Uns لا تفحص المستخدمين أو تتحقق منهم أو تُزكّيهم أو تُشرف عليهم، وليست طرفاً في أي تفاعل أو لقاء بين المستخدمين، ولا تتحمّل أي مسؤولية عنه.
7.3. توافق على توخّي الحذر وحُسن التقدير، بما في ذلك: المقابلة في أماكن عامة، وإخبار شخص تثق به بوجهتك، وعدم مشاركة معلومات شخصية أو مالية حساسة، والاتصال بالجهات المختصة فوراً إذا شعرت بعدم الأمان أو شهدت أو تعرّضت لسلوك غير قانوني.
7.4. إلى أقصى حد يسمح به النظام، فإنك تُبرئ ذمة Go Uns من أي وجميع المطالبات والدعاوى والأضرار الناشئة عن أو المتعلقة بأي تفاعل مع مستخدم آخر أو سلوكه، بما في ذلك أي لقاء شخصي.
8.1. محتواك. تتيح لك الخدمة إنشاء المحتوى ومشاركته، بما في ذلك رسائل محادثة الغرف والصور و"اللحظات" (ويُشار إليها مجتمعةً بـ "محتوى المستخدم"). وأنت تحتفظ بملكية محتواك.
8.2. الترخيص الممنوح لـ Go Uns. بإرسالك محتوى المستخدم، تمنح Go Uns ترخيصاً عالمياً غير حصري ومعفى من الإتاوات وقابلاً للترخيص من الباطن وللنقل، لاستضافة محتواك وتخزينه ونسخه وتعديله (للتنسيق والعرض) وتوزيعه وعرضه فقط لغرض تشغيل الخدمة وتقديمها وتأمينها والإشراف عليها وتحسينها. وينتهي هذا الترخيص عند حذف محتواك، باستثناء (أ) ما تمت مشاركته مع آخرين لم يحذفوه، و(ب) ما يلزم الاحتفاظ به بموجب النظام أو لأغراض النسخ الاحتياطي أو حل النزاعات أو الإنفاذ.
8.3. مسؤوليتك وضماناتك. أنت وحدك المسؤول عن محتواك. وتُقرّ وتضمن أنك تملك الحقوق اللازمة لمحتواك وأنه لا ينتهك هذه الشروط أو أي نظام أو حق لطرف ثالث. ويجب ألا تنشر صوراً لأشخاص آخرين دون موافقتهم.
8.4. عدم الالتزام بالتخزين. لسنا ملزمين بتخزين محتواك أو الاحتفاظ به أو إجراء نسخ احتياطي له، ويجوز لنا حذفه بما يتوافق مع ممارسات الاحتفاظ لدينا وهذه الشروط.
8.5. الملاحظات. إذا أرسلت إلينا اقتراحات أو ملاحظات، فإنك تمنحنا ترخيصاً دائماً وغير قابل للإلغاء ومعفى من الإتاوات لاستخدامها دون قيد أو تعويض.
9.1. من جانبك. يمكنك التوقف عن استخدام الخدمة وحذف حسابك في أي وقت. ويُعالَج الحذف وفقاً لسياسة الخصوصية الخاصة بنا.
9.2. من جانب Go Uns. يجوز لنا إيقاف وصولك إلى الخدمة كلياً أو جزئياً أو تقييده أو إنهاؤه، بإشعار أو دونه، إذا اعتقدنا بشكل معقول أن: (أ) خالفت هذه الشروط أو النظام المعمول به؛ (ب) قد يضر سلوكك بمستخدمين آخرين أو أطراف ثالثة أو بـ Go Uns؛ (ج) أن ذلك مطلوب بموجب النظام أو من جهة مختصة؛ أو (د) أننا أوقفنا الخدمة.
9.3. أثر الإنهاء. عند الإنهاء، ينتهي حقك في استخدام الخدمة فوراً. وتظل سارية الأقسام التي يقتضي طابعها البقاء (بما في ذلك الأقسام 7 و8.2 و10 و11 و12 و13 و14) بعد الإنهاء.
10.1. تُقدَّم الخدمة على أساس "كما هي" و"حسب توافرها". وإلى أقصى حد يسمح به النظام المعمول به، تُخلي Go Uns مسؤوليتها عن جميع الضمانات من أي نوع، صريحة كانت أو ضمنية، بما في ذلك الضمانات الضمنية الخاصة بالقابلية للتسويق والملاءمة لغرض معين وعدم الانتهاك.
10.2. لا نضمن أن تكون الخدمة دون انقطاع أو آمنة أو خالية من الأخطاء أو من المكوّنات الضارة، ولا أن تكون بيانات الخريطة الحرارية أو أعداد التواجد أو المعلومات الديموغرافية أو أي محتوى آخر دقيقة أو موثوقة أو مكتملة.
10.3. لسنا مسؤولين عن سلوك أي مستخدم أو طرف ثالث، سواء عبر الإنترنت أو خارجه، ولا نقدّم أي إقرارات بشأن أي مستخدم.
11.1. إلى أقصى حد يسمح به النظام المعمول به، لن تكون Go Uns أو مسؤولوها أو مديروها أو موظفوها أو وكلاؤها مسؤولين بأي حال عن أي أضرار غير مباشرة أو عرضية أو خاصة أو تبعية أو تأديبية أو رادعة، أو عن أي خسارة في الأرباح أو البيانات أو السمعة أو غيرها من الخسائر غير الملموسة، الناشئة عن أو المتعلقة باستخدامك (أو عدم قدرتك على استخدام) الخدمة، أو تفاعلاتك مع المستخدمين الآخرين، أو أي محتوى للمستخدم.
11.2. إلى أقصى حد يسمح به النظام المعمول به، لن تتجاوز المسؤولية الإجمالية الكلية لـ Go Uns عن جميع المطالبات المتعلقة بالخدمة الأكبر من: (أ) إجمالي المبالغ التي دفعتها لـ Go Uns مقابل الخدمة خلال الاثني عشر (12) شهراً السابقة للحدث المُنشئ للمطالبة، أو (ب) مئة ريال سعودي (100 ر.س).
11.3. لا يستبعد أي شيء في هذه الشروط أو يحدّ من المسؤولية التي لا يمكن استبعادها أو تحديدها بموجب النظام المعمول به في المملكة.
12.1. إلى أقصى حد يسمح به النظام، توافق على تعويض Go Uns ومسؤوليها ومديريها وموظفيها ووكلائها والدفاع عنهم وحمايتهم من وضد أي مطالبات أو التزامات أو أضرار أو خسائر أو نفقات (بما في ذلك الأتعاب القانونية المعقولة) الناشئة عن أو المتعلقة بـ: (أ) استخدامك للخدمة؛ (ب) محتواك؛ (ج) تفاعلاتك مع المستخدمين الآخرين أو سلوكك تجاههم، بما في ذلك أي لقاء شخصي؛ (د) مخالفتك لهذه الشروط؛ أو (هـ) مخالفتك لأي نظام أو حق لطرف ثالث.
13.1. يجوز لنا تعديل الخدمة أو أي ميزة فيها أو إيقافها أو وقفها في أي وقت.
13.2. يجوز لنا تحديث هذه الشروط من وقت لآخر. وإذا أجرينا تغييرات جوهرية، فسنقدّم إشعاراً معقولاً (مثلاً عبر إشعار داخل التطبيق أو بتحديث تاريخ "آخر تحديث"). ويُعدّ استمرارك في استخدام الخدمة بعد سريان التغييرات قبولاً لها. وإذا لم توافق، فعليك التوقف عن استخدام الخدمة.
14.1. القانون الحاكم. تخضع هذه الشروط وأي نزاع ينشأ عنها أو يتعلق بها أو بالخدمة لأنظمة ولوائح المملكة العربية السعودية.
14.2. حل النزاعات. يسعى الطرفان أولاً إلى حل أي نزاع ودياً عبر التفاوض بحُسن نية. وإذا لم يُحلّ النزاع خلال ثلاثين (30) يوماً، فيُحال إلى المحاكم والجهات المختصة في المملكة العربية السعودية التي يكون لها الاختصاص الحصري.
14.3. اللغة. تُقدَّم هذه الشروط باللغتين الإنجليزية والعربية. وفي حال وجود أي تعارض أو تباين، تكون الغلبة للنسخة العربية أمام المحاكم والجهات المختصة في المملكة.
14.4. قابلية الفصل. إذا تبيّن أن أي حكم من أحكام هذه الشروط غير قابل للإنفاذ، تظل بقية الأحكام سارية المفعول بالكامل.
14.5. الاتفاق الكامل. تُشكّل هذه الشروط وسياسة الخصوصية الاتفاق الكامل بينك وبين Go Uns بشأن الخدمة.
